2. No Guarantee of Deliverability Outcomes (Disclaimer of Warranties)

While SendSurety utilizes industry best practices, data-driven methodologies, and expert analysis to optimize your email infrastructure, we do not and cannot guarantee 100% inbox placement, specific open rates, or absolute immunity from spam filters. Email deliverability is ultimately controlled by third-party mailbox providers (e.g., Google, Yahoo, Microsoft) whose proprietary algorithms change frequently. By using our services, you acknowledge that SendSurety is not responsible for the ultimate delivery decisions made by these third-party providers. All services and information on the Site are provided on an "as-is" and "as-available" basis.

3. User Responsibilities & Acceptable Use

By engaging with SendSurety or using our Site, you agree that you will:

• Provide accurate, current, and complete information regarding your current email infrastructure, domain history, and sending practices.
• Not use our services to facilitate the sending of unsolicited emails (spam), phishing campaigns, malware, or any content that violates the Acceptable Use Policies of your ESP or violates anti-spam legislation (such as CAN-SPAM, GDPR, or CASL).
• Maintain the security of any credentials or access tokens you share with us for auditing purposes.

We reserve the right to refuse service or terminate our relationship immediately if we discover your business engages in malicious, illegal, or intentionally deceitful sending practices.

4. Intellectual Property

All content, design elements, text, graphics, and methodologies presented on the Site are the intellectual property of SendSurety unless otherwise noted. You may not copy, reproduce, distribute, or create derivative works from our Site content without our express written permission. Any custom remediation plans or audit reports provided to you during a consulting engagement are for your internal business use only.

5. Limitation of Liability

To the maximum extent permitted by applicable law, SendSurety shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of revenue, loss of data, business interruption, or the suspension/termination of your ESP accounts resulting from your use of our Site or services. Our total liability for any claims arising under these Terms shall not exceed the total amount you paid to SendSurety for the specific services in question.
